Fees, Terms and Conditions for the introduction of Private Cooks and Commercial Chefs for permanent employment and short or fixed term employment.

COOKFINDERS FEES

STAFF INTRODUCED BY COOKFINDERS

Agency fees are payable to Cookfinders in addition to the wages paid directly to the staff

Individual Lunch, Dinner or Daily fee of €35

Weekend or (Between 2-6 days) €50

One Week or more €70 for first week and €35 euro for every week thereafter

Summer / Winter Season 3 weeks salary

Permanent Private One month's salary

Permanent Private

Permanent Commercial 12% of annual salary

Individual Dinner or Lunch Parties
The cook will give a quote to the client depending on the occasion and chosen menu. This will be discussed between the client and the cook and will not be the responsibility of the agency.

Daily Charges
The agency will recommend a daily salary, which will be advertised on the job display board. If the client would like a quote including food costs then this will be discussed between the cook and the client depending on occasion and menu.

Weekend or Week Charges
The agency will recommend a salary for a week or weekend job, which will be displayed on the Job display board. Food charges will be additional to this and will be discussed between the client and the cook.

Permanent Staff
12% of annual salary. This fee becomes payable at the commencement of employment. If the engagement should end before the completion of one months' trial period, we will make a full refund less the temporary fee for the period worked.

 

COOKFINDERS TERMS AND CONDITIONS

1. DEFINITIONS

1.1 In these Terms of Business the following definitions apply: :

     "Agency" means: Cookfinders Agency , Killiskey Lodge, Ashford, Co.Wicklow, Ireland

     "Applicant" means: the person introduced by the Agency to the Client for an Engagement;

     "Client" means the person, firm or corporate body together with any subsidiary or associated company to whom the Applicant is introduced;

     "Engagement" means: the engagement, employment or use of the Applicant by the Client on a permanent or temporary basis, whether under a contract of service or for services; under an agency, licensee, franchise or partnership agreement; or any other engagement;

     "Introduction" means: the Client's interview of an Applicant in person or by telephone, following the Client's instruction to the Agency to search for an Applicant; or the passing to the Client of a curriculum vitæ or other information which identifies the Applicant and which leads to an Engagement of that Applicant by the Client;

1.2 References to the singular include the plural and references to the masculine include the feminine and vice versa where the context requires it.

1.3 The headings contained in these Terms are for convenience only and do not affect their interpretation.


2. THE CONTRACT

These Terms of Business are deemed to be accepted by the Client by virtue of an Introduction to, or the Engagement of an Applicant.

Unless otherwise agreed in writing by the Company, these Terms of Business shall prevail over any other terms of business or purchase conditions put forward by the Client.

No variation or alteration of these Terms of Business shall be valid unless approved in writing by the Company.

3. NOTIFICATION AND FEES

The Client agrees:
a) to notify the Agency immediately of any offer of an Engagement which it makes to the Applicant;
b)
to notify the Agency immediately that its offer of an Engagement to the Applicant has been accepted and where applicable to provide details of the gross annual salary payable to the Applicant; and
c) to pay the Agency's fee within 14 days of the date of invoice.

No fee is incurred by the Client until the Applicant commences the Engagement when the Agency will render an invoice to the Client for its fees.

The Agency reserves the right to charge interest on invoiced amounts unpaid for more than 14 days at the rate of 2% per month charged at on a daily basis from the due date until the date of actual payment.

The fee payable to the Agency by the Client for an Introduction resulting in an Engagement is calculated in accordance with the accompanying Scale of Fees.

If the cook does not complete the full term of agreed employment then the client is entitled to a rebate. The rebates are calculated as follows:

Discounted Rebate

Private Permanent

100% rebate less €100 administration charge

For all other Private Engagements:

A full refund will be provided on Individual, Weekend or Week Long engagements. For engagements longer than one week but no more than two weeks a €50 administration fee will be charged if the cook does not carry out the full length of employment. For placements between two weeks and 3 months the client will receive a full refund less 50% of total commission charged.

Commercial Permanent

0-3 Weeks 100% rebate less €650 Administration Charges

3-6 weeks 65% of total commission charged

4. SUITABILITY

All Applicants are interviewed and carefully selected by the Agency but the Client shall satisfy itself as to the suitability of the Applicant and shall take up any references provided by the Applicant and/or the Agency before engaging such Applicant. The Client shall be responsible for obtaining work and other permits if required and satisfying any other requirements (including PAYE and PRSI for permanent positions) or qualifications required by law of the country in which the Applicant is engaged to work.

5. LIABILITY
The Agency shall not be liable under any circumstances for any loss, injury, expense, damage, delay, costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by the Client arising from or in any way connected with the Agency seeking a Applicant for the Client or from the Introduction to or Engagement of any Applicant by the Client or from the failure of the Agency to introduce any Applicant.

6. CLIENT'S RESPONSIBILITIES

Terms regarding pay, duties, hours, holidays, length of notice should be agreed between the Client and the Applicant before the Applicant commences employment.

The Client is responsible for P.A.Y.E, Income Tax and PRSI deductions on behalf of the Applicant as an employee in addition to those liabilities as an employer. Where the Client wishes to cancel a short or fixed term Engagement of one month or less the Client must give the Agency at least one working day's notice, failing which the Agency shall be entitled to charge the full fee for the Engagement.

7.COOKS RESPONSIBILITIES

If the candidate is called upon a second time by the client to work again then no charge will be sought by the agency. However if the cook is unable to do the job then he or she must redirect the client to Cookfinders where they will be introduced to another cook by the agency.


8. LAW

These Terms are governed by Irish law and are subject to the exclusive jurisdiction of the Irish Courts.
